Alternative Fuels Insight - Basic User Terms

These terms and conditions (the “Terms”) are made and entered into between (i) DNV AS (hereinafter “DNV”) and (ii) you and the entity on whose behalf you accept these Terms (hereinafter “you”, “your” or “Customer”. The Terms are effective as of the date you click to accept the Terms and governs your access to and use of the Alternative Fuels Insight service (the “Service”) made available to the you on or through the Veracity platform.

By clicking “I accept”, you agree to be bound by the Terms and confirm that you are authorized to sign for and enter into binding agreements for the corporation, partnership, limited liability company or other entity you are representing who agrees to be bound by the Terms. In addition, you confirm that you do not act in capacity of physical person acting as consumer under applicable consumer law. If you do not have legal authority to bind the company as set out herein, please do not click to accept. In such case, you do not have rights to access and/or use the Service.

  1. As Basic User you have access to major parts of the Alternative Fuels Insight platform, as determined by DNV. This includes an interactive map with details on bunkering infrastructure for alternative fuels, interactive graphs with aggregated information on uptake of alternative fuels and technologies on ships, an Encyclopedia and the Fuel Finder where Basic Users can submit bunker requests to get in contact with suppliers of alternative fuels. The right to use the Service is limited to one personal, single user. Use of the Service by further users requires additional and separate user rights.
  2. DNV does not undertake any obligation to continue the Service, to provide maintenance or support, or to update or upgrade the Service or any of the information contained therein. DNV may in its sole discretion stop or suspend, fully or partially, the provision of the Service with immediate effect without incurring any liabilities.
  3. The Service is developed by DNV who holds all necessary rights to the Service and the information contained therein. No part of the Service or any information derived from the Service may be reproduced, transmitted, copied (in any form or by any means), distributed further or modified for commercial purposes. However, information derived from the Service may be copied, reproduced and used in presentations, newsletters and similar documents soleley for non-commercial purposes, subject to including (a) an explicit reference to (i) the Service, (ii) DNV, and (iii) the third party owner of the data if so indicated in the Service (“third party data owner”), and (b) a disclaimer that the positions or views stated in such document(s) are solely those of the author and do not necessarily represent the views of DNV and/or the third party data owner.
  4. Any reference in the Service to a commercial product, process, or service, or the use of any trade, firm or corporation name, or the inclusion of links or pointers to websites, is for information and convenience purposes only and does not constitute an endorsement, recommendation, certification or other endorsement by DNV.
  5. While DNV uses reasonable efforts to ensure that the information provided through or in connection with the Service is accurate and up-to-date, DNV makes no warranties in respect of the Service, the use thereof, or with respect to any results, information or advice provided to the Customer as part of the Service. To the extent permitted by applicable law, the Service, the information contained therein, and any results are provided "AS IS" without warranty of any kind, either express, implied or statutory, including, but not limited to, the warranties of merchantability or fitness for a particular purpose.
  6. Customer hereby waives any and all claim(s) against DNV, the companies in the DNV group of companies, and any third party data owner(s) (collectively “DNV Group”) arising from or in connection with this Agreement, the Service or the information contained therein, whether in contract, in tort (including negligence) or otherwise. To the extent liability cannot be waived in its entirety, the maximum cumulative liability of DNV Group arising out of or related to this Agreement, the Service, and/or the information contained therein shall be limited to the lesser of the remuneration paid by Customer to DNV under this Agreement in the previous twelve (12) month period or EUR 250.
  7. These Terms shall be exclusively governed and construed in accordance with the laws of Norway without regard to principles of conflicts of law. The Law on International Sales of Goods shall not apply. Any dispute arising in relation to or as a consequence of the Service, which cannot be settled amicably through negotiations between the parties, shall be brought exclusively in the courts of Oslo, Norway.
